Tenant banned after 13-year campaign of drunken abuse

THE full extent of the torment a nightmare neighbour inflicted on her community was revealed as she was banned from setting foot in the area she terrorised.

The file on Mary Mahoney, 47, was initially opened in 1998 after the first complaints were made about her drunken, abusive behaviour.

Rowdy mother-of-three Mahoney held parties in the garden of her home at all times of the day and night.

Her tirades of abuse, which included threats to kill, were launched at people around the Mackworth estate but particularly those living in Reigate Drive.

A catalogue of details about her intimidating behaviour was compiled by Derby Homes, including 30 incidents within six months reported by one resident.

Mahoney was given five harassment warnings as she drunkenly swore, shouted at and threatened neighbours.

She was finally evicted from her Derby Homes property in March but the housing organisation also wanted her banned from the area because of the anguish she had caused residents living there.

Now, after being given a dossier of evidence compiled over more than a decade, District Judge David Douce has agreed to ban her from parts of Mackworth.

One Reigate Drive resident who welcomed the ban yesterday said her life had been hell when Mahoney had lived in the street.

She said: "I can't begin to explain the stress. It was just the noise, shouting, abuse. She threatened to kill me. It was unbearable.

"Since she was evicted, this street is different. People have come out and now we all chat to each other and are friendly.

"Barriers have come down and that's because she's no longer here."

Another resident said: "When she was drunk there was a lot of noise. She used to have teenagers round her house all the time.

"I think she used to like to think she was still 18 and would drink and smoke with them.

"It's certainly been quieter without her."

Judge Douce agreed to an undertaking Mahoney made in court, meaning she is not allowed to live in the area or go to Reigate Drive for five years.

She is also banned from the Bull and Bush pub for two years after verbally abusing people in the pub in June.

The agreement also means Mahoney cannot harass or abuse another person while in Mackworth. That agreement will be in place for two years. If it is broken, she will be taken back to court.

While some residents wanted the ban to cover nearby shops too, they said it would at least stop her causing trouble in the area.

Derby Homes staff working on a dossier of evidence against her had to persuade reluctant witnesses to speak.

The housing organisation, which manages and maintains homes on behalf of the council, said the cost of Mahoney's behaviour was "incalculable".

Pat Butler, neighbourhood safety officer, worked on the case for more than a year and was receiving near-daily reports of verbal abuse by Mahoney.

She said: "We had 15 witnesses who were very intimidated, which is part of the reason it has taken so long to collect the evidence together to the court stage.

"When we started pulling together the complaints and looking back throughout her tenancy, it was clear the abuse and problems were sustained and serious."

Paul Pegg, of Mackworth Estate Community Association, said Mahoney and her family had caused huge problems in the area.

"She had been causing problems for at least 10 years," he said.

"She was buying drink for people who were underage and was making a nuisance of herself, often with drunken behaviour, and making a real noise.

"When she was evicted things improved dramatically and everyone was over the moon."

Derby Homes said every attempt to help Mahoney and her children, who also caused chaos on the estate, had been exhausted before court action was taken.

She was even signed up to a Family Intervention Programme – a "tough love" scheme which set down strict rules for Mahoney and her children to follow, including attending parenting and alcohol treatment courses.

But it works on a "three strikes and out" policy, so when Mahoney failed to stick to the terms for a third time, she was evicted.

Derby Homes chairman Bob Osler said: "Derby Homes tried to help this family with many different interventions and support mechanisms over several years and it is very disappointing that the mother was not prepared to accept this to help her to improve the lifestyle of herself and her family.

"Her behaviour led to her eviction in March 2011 but unfortunately, she has continued to return to the area and cause problems for others. This action is not a measure we take lightly but need to ensure that the wellbeing of all tenants are considered."

Police had issued five harassment warnings against Mahoney after receiving complaints against her.

The last harassment order was in March this year.

A spokeswoman for Derbyshire police said: "We've worked closely with Derby Homes to improve the quality of life for the residents of Mackworth."

Years of torment at hands of Mahoney

Jan 1998-Sep 2005: Accused of numerous occasions of anti-social behaviour against Resident A and family.

Apr-Oct 2002: Residents B and C witness 30 incidences of anti-social behaviour. Derby Homes gives her a warning.

Aug-Sep 2005: Resident D witnesses an additional seven cases of anti-social behaviour. She is warned again.

May 2007: Resident E subjected to anti-social behaviour.

Aug 2007: Resident A reports further cases of anti-social behaviour.

Sep 2007: Mahoney interviewed by Derby Homes. A referral for mediation is made.

Aug 2008: Anonymous complaint received by Derby Homes.

Aug 2008-Dec 2008: Resident C’s family is subjected to four instances of anti-social behaviour.

Oct 2008: Mahoney commits to receiving treatment for alcohol abuse and learning parenting skills.

Nov 2008: Resident A reports anti-social behaviour.

May 2009: Resident E’s family subjected to further abuse. Police give Mahoney a warning.

Aug 2009: Resident A again reports anti-social behaviour.

Oct 2009: Resident F reports anti-social behaviour.

Late summer 2009: Resident G is verbally abused and threatened by Mahoney.

Nov 2009: Third and final warning letter is sent out by Family Intervention Programme to Mahoney.

Nov 2009-April 2010: Resident A’s family subjected to 14 incidents of anti-social behaviour.

Dec 2009: Verbally abusive to Derby Homes staff.

Jan 2010: Resident H subjected to three incidents of anti-social behaviour; resident F and friend suffer anti-social behaviour; warning of legal action by Derby Homes sent.

Jan-April 2010: Neighbourhood officers visit all previous complainants to persuade them to give evidence.

Mar 2010: Resident F witnesses or is aware of five cases of anti-social behaviour by Mahoney, including racial hatred; Resident H subjected to anti-social behaviour; Resident F’s relative witnesses racial hatred.

Apr 2010: Resident F received more abuse; resident G subjected to anti-social behaviour while at a funeral.

Jul 2010: Witness statements are signed and entered into court.

Aug 2010: Resident A reports further anti-social behaviour. Injunction considered but resident too nervous to go to court.

Feb 2011: Court hearing: possession is granted to Derby Homes in 28 days.

Mar 7, 2011: Mahoney leaves property and returns keys.

Apr 13, 2011: Statement drafted for injunction with exclusion from Mackworth area.

Aug 9: Injunction hearing. Mahoney asked for one week to present defence stating injunction

    No sorry...you're wrong on that one, you seem to think just cus we have a landlord that they actually do something!!!! Think you need to read some of my earlier post's...Derwent Living prefer these anti socials...because THEY don't work...therefore...they get their rent paid on time every month...thanks to housing benefit, the decent tenants who work...may lose their job tomorrow so become unable to pay their rent...it's them they don't give a **** about!!!”

    Its become unbelieveable, its like our property belongs to everyone else and they are allowed to wander onto it when they see fit.

    I have no idea how I would have explained the condom to my two primary school age children. The noise from music and shouting alone is enough, the other stuff is just beyond belief. We have applied to be housed with a housing association and we pray they will find us somewhere very soon.

    We have filled in the diary forms for the council but I am sure that will be a long process, how is a normal family meant to function whilst they are living like we have to ? Even down to the most basic of needs, such as a full nights sleep so you can go to work (and pay your mortgage and council tax)

    It will mean taking our children out of their school and away from their friends probably but its better than living here in fear and utter desperation.”
