Woman is evicted from her home after being abusive to neighbours
A TENANT has been evicted from her council home for intimidating neighbours and being aggressive towards a councillor.
Despite her denials of the allegations of anti-social behaviour, a judge ruled that Linda Johnson had to leave her Derby Homes property in Holbrook Road, Alvaston within 28 days.
The 52-year-old moved into the house in 2009 but became the cause for complaint from neighbours.
During the hearing at Nottingham County Court, residents and Councillor Ranjit Banwait said she had been abusive and aggressive.
Mr Banwait, councillor for Boulton ward, told the court she had sworn at him, using the f-word and then, later the same day, shoved him violently in a car park.
The county court also heard from neighbours Wendy West and Jordan Weston, who were asked by Derby Homes to keep a note of any disturbances.
They wrote down incidents of loud music in the early hours and intimidating behaviour by Mrs Johnson which they said began to get worse last year.
When questioned about those and another 17 alleged complaints against her, Mrs Johnson denied each one happened, including the incidents with Mr Banwait – whom she said she had "never seen before".
Mrs Johnson said she suffered bipolar disorder and had previously been a victim of domestic abuse.
But the court ruled that Derby Homes should be allowed to evict Mrs Johnson.
It was originally intended they get possession of the property immediately.
However, Mrs Johnson had three convictions – two for harassment and one for using racially aggravated language.
And the housing organisation said she was banned from the area where the property was. It means she will now have to get a temporary 24-hour lifting of that ban to remove her belongings.
Mary Holmes, customer services manager at Derby Homes, said: "If we have got the evidence, we will try to help the victims in any way we can and seek possession. We are working with residents to alleviate these problems."
Mr Banwait praised those residents who had come forward to provide evidence.
He said: "I admire their courage and they set the right example. For a successful eviction, Derby Homes needs people to come forward and they will be given the support needed.
"Those tenants who do not live by the terms of their tenancy and commit anti-social behaviour need to know they will be evicted."

“Does anybody actually know what the procedure is for "humanoids" (and I use the term loosely) that are evicted this way?
Does Derby Homes automatically move them somewhere else, or do they go onto a waiting list?”

“smith dcfc yeah the taxpayers may pay for the majority of peoples homes through derby homes but why tar all derby homes tenants and council house tenants with the same brush as i live in a 2 bed council house in alvaston but pay £400 pcm and go and work 45 hours a week to do so”

“And where will she move too now and who will she pay (or not as is the most probible case it will be the tax payer) too. as she will still qualify for a house some where. I doubt shell learn her lesson and will continue to be the bane of all the good people who have the miss fortune to have her move next too.”
