Extradition bid hearing in October

Thursday, July 02, 2009, 07:30

A DATE has been set for the extradition hearing of one of two men wanted in connection with the murder of Derby soldier Michael Newman.

Police in Derbyshire want to bring Declan "Whacker" Duffy back to the county 17 years after the murder of Sgt Newman, shot in the head at point-blank range as he left an Army careers office in the city.

Duffy was arrested by police in Ireland in May, along with Anthony Gorman, following a request by officers in Derbyshire.

He is accused of killing Sgt Newman, a 34-year-old father of one.

He had never served in Northern Ireland and was unarmed and out of uniform when he was gunned down.

Duffy is also accused of conspiring to commit murder between January 1, 1992, and April 13, 1992.

The 35-year-old father-of-two, who is currently in custody on other matters, appeared at the High Court in Dublin yesterday.

A date of October 8 was set for his extradition hearing where it will be decided if Duffy should be sent to England to stand trial.

Gorman, 39, is also charged with murder.

He is on bail pending a hearing later this month.

A previous attempt to extradite Gorman in 1994 failed because of legal arguments made by his lawyers.

But it is hoped the latest attempt will be successful following a change in the law.

Joseph Magee was also named as a suspect by Derbyshire police.

He was jailed for 25 years in 2004 after pleading guilty to Sgt Newman's murder on the understanding he would be released two years later under the Good Friday Agreement.
